Moderated “Advanced Topics in Mediation Advocacy: Confidentiality and Competence” Kentucky Bar Association ADR Section CLE Program

As chair of the Kentucky Bar Association (KBA) Alternative Dispute Resolution (ADR) Section, I had the honor and opportunity to participate in the organization and development of, and to moderate, the Kentucky Continuing Legal Education (CLE) Program presented by Jeff Kichaven, “Advanced Topics in Mediation Advocacy: Confidentiality and Competence.”

“Chambers-ranked mediator Jeff Kichaven [guided] us through a discussion of two of the most sensitive and important topics in mediation advocacy: Confidentiality and Competence. Regarding confidentiality, what happens when you mediate online and people are in different states? Which state’s laws apply? Does the existence of a Confidentiality Agreement make a difference? Regarding competence, you have the duty to represent your client competently. How much negotiation responsibility can you delegate to a neutral mediator and still discharge your own fiduciary obligations? The answers will surprise you, and just may change how you practice.”

This CLE webinar program was held on 8 January 2024 at 12:30 PM Eastern Time (ET), was accredited in Kentucky for 1 CLE credit, and was sponsored by the KBA ADR Section. Registration was free and open to all KBA members. Information and registration were available here.
